Farahs Legal Pty Ltd ABN 31 659 885 159 - ACN 659 885 159, trading as Farahs Legal (FL, we, us, our) is subject to the provisions of the Privacy Act 1988 (Cth) (the Act) and any rules, regulations or principals (including the ‘Australian Privacy Principles’) delegated by or made under the Act.

Our policies in respect of managing and protecting your personal information in accordance are set out below. 

  1. What kinds of personal information do we collect? 

We collect and hold your contact details, any information you share with us (including account details that you share for the purpose of transferring moneys to our trust account, office account (or both)) and records of your communications and other interactions with us (collectively, your personal information).  

  1. How do we collect and hold your personal information? 

Generally, we collect information from you directly from the information you share with or elect to transmit to us (by email, file transfer or otherwise). In some instances, we may collect data from your use of our website including any interactions you have with our website, browsing patterns and cookies.  

  1. Why do we collect your personal information? 

We are required to collect certain personal information to enable us to manage your matter(s). We are also obligated to fulfil certain statutory obligations pursuant to the Legal Profession Act 2004 (NSW), Legal Profession Uniform Law 2014 (NSW), Legal Profession Uniform Law Australian Solicitors’ Conduct Rules 2015 (Solicitors Rules) and any associated regulations, the Corporations Act 2001 (Cth) and other similar legislation. We would not be able to carry out certain critical functions and fulfil these obligations were we not able to store your personal information. 

We may, from time to time (subject to any notice from you opting out under part 5), send emails providing updates on legal subjects that relate specifically to your matter(s) and/or affairs. Such communications may include communications of a nature marketing our firm and our services (Marketing Communications). 

  1. Use and disclosure of your personal information 

We will not disclose or share your personal information with any third party unless: 

  • doing so is reasonably necessary for any of the purposes described above (in which case we will inform you); 

  • doing so is legally required or mandated by law, Court or tribunal (subject always to our duties of confidentiality); 

  • we have reason to suspect unlawful activity or misconduct of a serious nature that relates to our functions or activities has been, is being or may be engaged in, and we believe that the collection, use or disclosure is necessary in order for us to take appropriate action; 

  • the assets and/or operations of our business are transferred to another entity pursuant to a sale; 

  • doing so is expressly permitted and/or required under the Act; or  

  • you have provided consent for us to make the relevant disclosure(s). 

  1. If you do not want your personal information to be disclosed / opting out 

In the event that you wish to elect to opt out of Marketing Communications you may notify us in writing and we will cease to send any further Marketing Communications thereafter.  

  1. Storage and security of personal information

We will take all reasonably necessary precautions to ensure that your personal information is kept from misuse, loss, unauthorised disclosure or access or unauthorised modification. If a third party is given access to your personal information (in accordance with the matters set under part 4), we will take reasonable steps to ensure that the same protections as set out in this privacy policy.

We collect personal information through software such as cookies. A cookie is a text-only string of information that a website transfers to the cookie file of the browser on the hard disk of a user's computer so that the website can remember that user. In short, a cookie facilitates a user's passage through a website.

This Privacy Policy does not apply to linked websites.

  1. Rights to access and correction of your personal information

Should you wish to access your personal information please contact us and we will provide same unless we are prevented from doing so by operation of law. Please direct any requests for access to your personal information to contact@farahslegal.com.au. You are entitled to ask us to correct any of your personal information should doing so become necessary due to any inaccuracy(s). 

  1. Circumstances in which we may deny access  

In some circumstances it may be appropriate and lawful for us to deny access, including if:

  • we reasonably believe that giving access would pose a serious threat to the life, health or safety of any individual, or to public health or public safety; 

  • providing access would have an unreasonable impact on the privacy of another individual; 

  • the request is frivolous or vexatious; 

  • the information relates to existing or anticipated legal proceedings between you and us and the information would not be accessible by the process of legal discovery in those proceedings; 

  • we have reason to suspect that unlawful activity, or misconduct of a serious nature, relating to our functions or activities has been, is being or may be engaged in, and giving access would be likely to prejudice the taking of appropriate action in relation to the matter; 

  • providing access would be unlawful or if denying access is required or authorised under Australian law or a court/tribunal order; or 

  • giving access would be likely to prejudice one or more enforcement activities conducted by, or on behalf of, an enforcement body. 

  1. GDPR

If you are a resident of the European Union or are accessing our website or using our services from within that location, we are required to comply with the General Data Protection Regulation (EU) 2016/679 (GDPR).
